The Italian legislation establishes that motor vehicles, including trailers, may circulate on public roads (or equivalent areas) only if covered by a liability insurance. This is a compulsory insurance whose object is established by law. The insurance includes both liability for damage to property (such as other vehicles, guard rails, etc.) and liability for damage to people.
How to get compensation
The law governs various compensation procedures, for istance the transported person must send his claim to the insurance company of the vehicle in which he was traveling, regardless of the driver’s responsibility.
The compensation claim must be sent by a registered certified mail (posta elettronica certificata) and contain the data of the injured party, the description of the dynamics of the accident, the counterparty data (if known), the place, date and time where the things and / or the vehicle can be inspected by a company technician and specify the damages suffered.
Time limits
The law provides for a two-year limitation period within which the injured party must take action. A longer term is envisaged in the event of a crime (i.e. personal injury).
The insurance company, once received the claim, must respect a timeline established by the law; failure by the company to comply with the deadlines is sanctioned by the Italian Insurance Supervisory Institute (IVASS), to which everyone can turn to complain of a disservice.
